Publishing

Having your music published is definitely not for the faint of heart as it involves signing a Publishing Agreement that specifies the legal transfer of your copyright for the song or songs to the music publisher. AudioMoxie's minimum is three songs. If it is a "major" publisher and you are a writer that has a proven track record (previously published and are selling tons of CDs or downloads, or you have a "major buzz"), the publisher will usually offer you a cash advance on future royalties. We do not offer advances at this time.

How money is made: The publisher splits royalties 50/50 with you on any royalties made from the "placement" your song(s) with another artist, producer, film company, TV production company, etc. Many times an "indie" publisher (like AudioMoxie) will offer what is known as a reversion clause that states if the publisher fails to "place" your song within a certain amount of time, (our placement term is a minimum of two years), the copyright reverts (is transferred back) to the writer.

However, once the song is "placed", the publisher retains the copyright to the song and reversion is no longer available to the writer. Even though this means the writer will receive royalties, it is undoubtedly the hardest part for most writers to stomach. Fortunately, laws have been established to protect writers so that no matter what happens with your song you will still retain the writer's share of the pie. This means as the writer, or writers as the case may be, you will never own less than 50% of the "song pie".

As far as performing rights organizations (PRO's), if you have not already done so, you will need to affiliate with either ASCAP or BMI. Either one is fine. We have publishing companies with both!

Whew! The main thing to consider before signing any Publishing Agreement is whether the publisher can do more to advance your songwriting career than you can do by yourself. If you consider all of those factors and you still want to go forward with a Publishing Agreement, you can go in with your eyes open.
